The following terms apply to the DoseDoctor.com web site (herein referred to as "DoseDoctor.com", "DoseDoctor", "DoseDoctor Site", or "site"). The DoseDoctor.com web site is owned and operated by DoseDoctor, LLC located and operated in Cape Girardeau, MO, in the Unites States of America. The materials obtained in, on, or from the DoseDoctor Site are provided as a service to its customers and the general public for personal use and shall be used for informational purposes only. In this agreement, the term "you" refers to the "member" or "subscriber" who purchased a DoseDoctor subscription and anyone that accesses and uses DoseDoctor through that "member's" or "subscriber's" account. DoseDoctor is intended for use only by legal residents of the United States 18 years of age and older. This agreement must be completed, understood and agreed to by a person over 18. If a parent or guardian wishes to permit a person under 18, under his or her supervision, to use this site, the parent or guardian assumes all risk and liabilities associated with that minor's use of the DoseDoctor Site. Any unintended, or unauthorized, use by children should be reported to DoseDoctor immediately by using the DoseDoctor Contact Us Form. By subscribing to, and using this site, and/or downloading materials from this site, you agree to these Terms and Conditions. If you do not agree to all of these Terms and Conditions of use, do not use this site!
CHILDREN'S PRIVACY
DoseDoctor is committed to protecting the privacy of children. You should be aware that this Site is not intended or designed to attract children under the age of 13. DoseDoctor does not collect personally identifiable information from any person DoseDoctor actually knows is a child under the age of 13. The contents of the DoseDoctor Site, including text, graphics, images, medication names, medication doses, and information ("Content") obtained from DoseDoctor and other material contained on the DoseDoctor Site are for informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. DoseDoctor DOES NOT RECOMMEND WHAT MEDICATION TO USE. Also, while you may ask DoseDoctor for dosing information for multiple medications for the same child, DoseDoctor assumes you are using this for informational purposes only. DO NOT GIVE YOUR CHILD MORE THAN ONE MEDICATION without first consulting your doctor. DoseDoctor DOES NOT SUBSTITUTE FOR YOUR PHYSICIAN'S KNOWLEDGE OF YOUR CHILD'S HEALTH. Should you have any health care related questions, please consult with your physician or other qualified health care provider promptly. Never disregard professional medical advice or delay in seeking it because of something you have obtained from the DoseDoctor Site. As with all medications you give your child, ALWAYS READ MEDICATION PACKAGE LABELS CAREFULLY.

DoseDoctor does not recommend or endorse any specific physicians, products, opinions, or other information that may be mentioned on the Site. The DoseDoctor.com web site, nor any contributing physicians, directly or indirectly practice medicine, render medical advice or dispense medical services as part of the DoseDoctor.com web site. Reliance on any information provided by DoseDoctor, DoseDoctor employees, physician and pharmacy contributors, others appearing on the Site at the invitation of DoseDoctor, or other visitors to the Site is solely at your own risk.
SUBSCRIPTION DEFINITIONS
A "subscription" to DoseDoctor and the DoseDoctor Site grants rights and privileges to the access and use of DoseDoctor as stated in these Terms & Conditions. There may be times during these "subscriptions" that you are unable to access the Site due to maintenance, updates, format changes, server/internet disruptions, mechanical failure, forces of nature or other unforeseeable events. DoseDoctor is not liable to the subscriber for such service disruptions and is not obligated to refund, repay, or otherwise compensate you the subscriber for these events.
A “Subscription” or “Membership” constitutes an agreement between you and DoseDoctor and is defined as a period of subscription that begins on the date you accept these Terms & Conditions of Use and subscribe to DoseDoctor, and continues for as long as you, the subscriber, continue your membership and continue use of DoseDoctor and the DoseDoctor Site so long as DoseDoctor is in operation and continues to be owned and operated by DoseDoctor, LLC. DoseDoctor reserves the right to cancel any subscription if any subscriber fails to abide by the Privacy Policy or Terms & Conditions of Use or violates the rights of DoseDoctor or any third-party.
LIABILITY OF DOSEDOCTOR, ITS LICENSORS, AND CONTRIBUTORS
The use of the DoseDoctor Site and the Content is at your own risk.
When using the DoseDoctor Site, information will be transmitted over a medium that may be beyond the control and jurisdiction of DoseDoctor. Accordingly, DoseDoctor assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the DoseDoctor Site.

Without limiting the foregoing, DoseDoctor, its contributors, physician or pharmacy contributors, programmers, internet servers, licensors, and its suppliers make no representations or warranties about the following: 1) The accuracy, reliability, completeness, currentness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the DoseDoctor Site or DoseDoctor. 2) The satisfaction of any government regulations requiring the approval or compliance of any software tools with regard to the Content contained on the DoseDoctor Site.
In no event shall DoseDoctor, its licensors, contributors, programmers, internet servers, physician or pharmacy contributors, its suppliers, or any third parties mentioned on the DoseDoctor Site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the DoseDoctor Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not DoseDoctor, its licensors, its physician contributors, its suppliers, or any third parties mentioned on the DoseDoctor Site are advised of the possibility of such damages. DoseDoctor, its licensors, its physician contributors, its suppliers, or any third parties mentioned on the DoseDoctor Site shall be liable only to the extent of actual damages incurred by you, not to exceed U.S. $1000. DoseDoctor, its licensors, its physician contributors, its suppliers, or any third parties mentioned on the DoseDoctor Site are not liable for any personal injury, including death, caused by your use or misuse of the Site, Content, or Public Areas (as defined below). Any claims arising in connection with your use of the Site, any Content, or the Public Areas must be brought within one (1) year of the date of the event giving rise to such action occurred. Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.
USER SUBMISSIONS
The personal information you submit to DoseDoctor is governed by the DoseDoctor Privacy Policy. To the extent there is an inconsistency between this Agreement and the DoseDoctor Privacy Policy, this Agreement shall govern.
You agree that you will not send or transmit to DoseDoctor by email, (including through the email addresses listed on the "Contact Us" link) any communication or content that infringes or violates any rights of any party.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the DoseDoctor.com web site, you agree to not use the DoseDoctor.com web site for any purpose that is unlawful or prohibited by these Terms of Use. You may not use the DoseDoctor.com web site in any manner which could damage, disable, overburden or impair the DoseDoctor.com web site or interfere with any other party's use and enjoyment of the DoseDoctor.com web site. It is your sole responsibility to (1) control the dissemination and use of activation codes and passwords; (2) authorize, monitor, and control access to and use of your DoseDoctor account and password; (3) promptly inform DoseDoctor of any need to deactivate a password. You grant DoseDoctor and all other persons or entities involved in the operation of the Site the right to transmit, monitor, retrieve, store, and use your information in connection with the operation of the Site. INDEMNITY
You agree to defend, indemnify, and hold DoseDoctor, its officers, directors, physician and pharmacy contributors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
USE OUTSIDE THE UNITED STATES OF AMERICA
DoseDoctor is based in Cape Girardeau, Missouri, in the United States of America. DoseDoctor makes no claims that DoseDoctor may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the DoseDoctor Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
UPDATES
The information and services included within, or available through, the DoseDoctor.com web site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. DoseDoctor may make improvements and/or changes to the DoseDoctor.com web site at any time. JURISDICTION
You expressly agree that exclusive jurisdiction for any dispute with DoseDoctor, or in any way relating to your use of the DoseDoctor Site, resides in the courts of the State of Missouri and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Missouri in connection with any such dispute including any claim involving DoseDoctor or its affiliates, subsidiaries, employees, physician and pharmacy contributors, contractors, officers, directors, telecommunication providers, and content providers.
These Terms and Conditions are governed by the internal substantive laws of the State of Missouri, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

FINAL AGREEMENT
